A county clerk who invoked "God's authority" in refusing to issue marriage licenses to same-sex couples in Kentucky is at risk of a contempt of court citation with jail time and fines. Two men who Kim Davis denied a license on Monday filed a contempt of court motion with the federal judge who two weeks ago ordered her to comply with the Supreme Court ruling legalizing same-sex marriages.
Davis has been ordered to appear in U.S. District Court Thursday morning to answer the charges.
The U.S. Supreme Court recently denied a request by Davis for a temporary injunction of the federal order so her lawyers would have more time to challenge it.
News cameras were rolling when she denied a marriage license to David Moore and David Ermold in the Rowan County courthouse in Morehead, Kentucky, Monday. Davis, n Apostolic Christian, told the couple she acting "under God's authority."
Rowan County Attorney Cecil Watkins has asked the state attorney general to appoint a special prosecutor to decide if Davis should be charged with official misconduct for failing to perform her public duties. She's refused issue any licenses since June.
