A large Spanish man allegedly sat on a small donkey in a nativity display, causing an explosion of internal organs that killed the animal, a donkey rescue group said in a lawsuit against the man.

The man has already been charged with animal cruelty by authorities in Lucena, Spain, after a local animal rights group alerted police to the Christmas 2014 incident.

The five-month-old donkey, named Platero, died two days after the man sat on his back "as a joke," according to the group suing.

The pro-donkey group El Refugio Del Burrito filed a lawsuit recently accusing the man of jumping the Bethlenhem stable fence sit on Platero for a photo that he posted on a Whatsapp account.
