
Was Destiny Marie Diciccio charged with "Disorderly Conduct - Uttering an Illegal Opinion" under Florida's new anti-antisemitism law and is she facing 30 days in jail for this? No, that's not true: Court records show she was charged for disorderly conduct involving the throwing of a slice of pizza. According to those records she pleaded "no contest" but there was no mention of antisemitism or the uttering of opinions in any of the court or police documents and she was not sentenced to jail.
The claim appeared in a screenshot of what looked like a social media post of unclear origin that was attached to a post on X (archived here) where it was published on August 22, 2025 with a comment that read "30 days in jail for Antisemitism. The first person charged under Florida law." The text in the screenshot read:
Meet 27 y.o. Destiny Marie Diciccio, who has the distinct dishonor of being the first person charged under Florida's new anti-antisemitism law. She is charged with Disorderly Conduct - Uttering an Illegal Opinion. She now faces mandatory 30 days in jail with 10 on work duty

The Pinellas County court website has details on the case "25-11036-MM : STATE OF FLORIDA vs. DICICCIO, DESTINY MARIE" (archived here) which shows the charge as "DISORDERLY CONDUCT Statute: 877.03 MISDEMEANOR - 2ND DEGREE":

Florida's statute 877.03 (archived here) does not mention antisemitism at all:
877.03 Breach of the peace; disorderly conduct.--Whoever commits such acts as are of a nature to corrupt the public morals, or outrage the sense of public decency, or affect the peace and quiet of persons who may witness them, or engages in brawling or fighting, or engages in such conduct as to constitute a breach of the peace or disorderly conduct, shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
The complaint/arrest affidavit included in the case did not mention antisemitism either when describing the "disorderly conduct" in question:
DID THEN AND THERE ENGAGE IN SUCH CONDUCT AS TO CONSTITUTE DISORDERLY CONDUCT, TO-WIT: BEGAN YELLING A SCREAMING AT ANOTHER CUSTOMER AND THEN THREW A SLICE OF PIZZA AT THE OTHER INVOLVED SUBJECT, WHICH CONSTITUTED A BREACH OF THE PEACE.
THE DEFENDANT ENGAGED IN FIGHTING AN TUMULTUOUS BEHAVIOR ON THE PREMISES OF A LICENSED ESTABLISHMENT IN THE CITY OF ST PETERSBURG. THESE ACTIONS CORRUPTED THE PUBLIC MORALS INSIDE THE ESTABLISHMENT.
